These Terms & Conditions ("Terms") govern your access to and use of Zeph apps and websites (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Use of the Services

• You may use the Services only in compliance with applicable laws and these Terms.
• You are responsible for your activity and for maintaining the security of your devices and accounts.
• We may modify or discontinue features at any time, without notice.

2. Content & License

Zeph and its licensors own all rights, title, and interest in the Services and related content. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial purposes.

3. User Conduct

• Do not misuse the Services, interfere with their normal operation, or attempt to access them by any method other than the interfaces we provide.
• Do not reverse engineer, decompile, or attempt to derive the source code of any part of the Services, except to the extent permitted by law.

4. Third‑Party Services

The Services may link to or rely on third‑party content, services, or platforms. Zeph is not responsible for and does not endorse third‑party services. Your use of them is subject to their terms and privacy policies.

5. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. ZEPH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEPH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL THE TOTAL LIABILITY OF ZEPH FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ZEPH, IF ANY, FOR THE SERVICES THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE; OR (B) USD $50.

7. Indemnification

You agree to defend, indemnify, and hold harmless Zeph and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services or your violation of these Terms.

8. App Stores & Subscriptions

If you download our apps from the Apple App Store or Google Play, you also agree to comply with their terms and policies. Purchases, billing, and refunds for in‑app purchases or subscriptions are handled by the respective app stores and are subject to their policies. Zeph does not control and is not responsible for app‑store billing or refund decisions.

9. Termination

We may suspend or terminate access to the Services at any time for any reason, including if we reasonably believe you have violated these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Venue for any disputes shall be the state or federal courts located in California, and you consent to their jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will revise the “Effective date” above when changes are made. Your continued use of the Services constitutes acceptance of the updated Terms.
